Agreement to Terms

When you hire SunWay Westchester Landscaping for services, you agree to these terms. We want to make sure everything is clear and simple, so there are no surprises. By using our services, you accept these terms in full.

Services We Provide

We offer a range of landscaping services including lawn care, landscape design, hardscaping, irrigation systems, tree and shrub care, mulching, sod installation, and landscape lighting. Each service will be detailed in your quote or service agreement. We will do our best to complete your project as described, but sometimes weather or other factors outside our control can affect timing.

Pricing and Payment

All prices are provided in your written estimate or quote. Prices are subject to change if you request additional work or if we discover issues that were not visible during the initial assessment. Here is how payment works:

  • For small projects, payment is due when the work is completed.
  • For larger projects, we may require a deposit before we start and the balance when we finish.
  • We accept cash, checks, and major credit cards.
  • Late payments may result in a service hold and additional fees.

Scheduling and Cancellations

We will work with you to schedule services at a convenient time. If you need to cancel or reschedule, please let us know at least 24 hours in advance. Last-minute cancellations may result in a fee, especially if we have already purchased materials for your project. Bad weather can also delay work, and we will contact you to reschedule if that happens.

Your Responsibilities

To help us do the best job possible, you agree to:

  • Provide clear access to the work area, including gates, driveways, and yards.
  • Mark or inform us of any underground utilities, sprinkler lines, or other hidden features before we start.
  • Keep pets indoors or secured during service visits for safety.
  • Notify us of any specific concerns or restrictions for your property.

Warranty and Guarantee

We stand behind our work. If you are not happy with the results, let us know within 7 days and we will work with you to make it right. For plant installations, we offer a limited warranty based on the specific plants and conditions. Normal wear and tear, improper maintenance, or damage from weather or pests are not covered by our warranty.

Limitation of Liability

We carry insurance and take care to avoid damage to your property. However, we are not responsible for damage caused by hidden underground utilities, unexpected soil conditions, or pre-existing issues that were not disclosed. Our total liability for any claim will not exceed the amount you paid for the service in question.

Dispute Resolution

If you have a problem with our services, please contact us first so we can try to resolve it directly. Most issues can be handled quickly and fairly. If we cannot reach an agreement, any disputes will be resolved in accordance with the laws of the state of Florida.

Changes to Terms

We may update these terms from time to time. If we make significant changes, we will notify you by email or post a notice on our website. Your continued use of our services after changes are made means you accept the new terms.
